Lens Terms of Service (pending counsel review)

What Lens is

Lens is a directory and booking tool that connects people who need photo and video work ("clients") with independent photographers, videographers, crew and production teams ("pros"). MAD Monkey Media runs the platform. We are not a party to the work agreed between a client and a pro, we do not employ pros, and pros are independent businesses who set their own prices and terms.

Your account

• You sign in with MAD Login. Keep your sign-in secure; you are responsible for activity on your account.
• You must be at least 18 and able to enter a contract.
• Give accurate information. Do not impersonate anyone or list work that is not yours.

Pros and teams

• You own your photos, videos and text. You let us show them on Lens and in Lens search and marketing about your profile while your profile is public.
• Prices, day rates and half-day rates you set are yours. Team Builder quotes use your rates; where you have none, Lens shows a clearly labelled estimate.
• A team owner controls the team page and roster and is responsible for the people they invite. Team members keep their own profiles and plans.
• Answer inquiries and crew requests honestly. Accepting a crew request means you intend to do the job on the stated terms.

Clients

• Browsing, saving and messaging pros is free. Free accounts can start 3 jobs (booking or crew requests) a month; paid client plans raise or remove that limit.
• A quote or crew request is not a booking until the pro accepts, and nothing is charged by sending one.
• When you pay a booking through Lens, the client-side Lens fee for your plan is shown before you pay and added to the booking price.

Plans and fees

• Pro plans: Free free, Solo $29/month, Crew $79/month, Studio $199/month, Network $499/month. Client plans: Client Free free, Plus $19/month, Business $59/month. Annual billing is 10 times the monthly price.
• Booking fee, only on bookings paid through Lens: a 5% client fee added to the booking price and a 5% talent fee taken from the pro's payout, on every plan; with a $5 minimum on the combined fee. Card processing is passed through at cost.
• No fee is charged on inquiries, messages or crew requests, and a pro may take payment outside Lens.
• Paid plans renew until canceled. During beta, a paid plan can be unlocked free with a card on file; the card is charged at launch for the plan you are on unless you switch to Free before then. We email you 30, 7 and 1 days before.

Content and conduct

• No unlawful, infringing, hateful or explicit content; no spam; no scraping; no attempts to break or overload Lens.
• We may remove content or suspend accounts that break these terms, and we will tell you why when we can.
• Reviews on Lens come only from clients who booked and paid for a completed job through Lens.

Disclaimers and limits

Lens is provided as is. We do not guarantee any pro's work, availability or results, or any client's payment, and we do not offer escrow, insurance or a money-back guarantee. To the extent the law allows, our total liability to you for any claim about Lens is limited to the fees you paid us in the 12 months before the claim.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules.

Changes

We will post changes here and tell account holders about material changes before they take effect.
